As previously reported, the United States Department of Labor adopted a Final Rule in 2016 significantly expanding the overtime protections of federal law. In a closely tracked legal opposition, a federal district court today held the overtime rule invalid: "The Department has exceeded its authority and gone too far with the Final Rule." A copy of the decision is available
here.
The Department has already indicated it will reconsider the content of the rule by re-opening it for comment. It remains to be seen whether an amended rule will be forthcoming or an appeal taken from today's order.
