PHILADELPHIA — Stradley Ronon senior counsel Samuel Arena served as co-editor of the American Bar Association (ABA)’s new insurance law resource for lawyers, insurers, policyholders and courts, “The Insurer's Duty to Defend: Issues and Analysis.”
The book, which analyzes key aspects of the insurer’s duty to defend in a practical issue-based fashion, begins with a discussion of the fundamental aspects of the insurer’s duty to defend and ends with an examination of nonexecution agreements and consent judgments. In between, the book covers topics such as: defense under a reservation of rights or nonwaiver agreement; conflicts of interest in insurance defense; an insurer’s occasional duty to prosecute claims on the insured’s behalf; defense of post-judgment proceedings; the termination of the duty to defend; the recoupment and allocation of defense costs; the consequences of the breach of the duty to defend; and defense under a defense-cost-indemnification policy.
For more than four decades, Sam has concentrated his practice on insurance law and fidelity and surety law. He has represented insurance companies nationally in complex insurance coverage, extra-contractual liability, and fidelity and surety matters. Sam is a fellow of the American College of Coverage Counsel and an adjunct professor at Villanova University Charles Widger School of Law where he teaches Advanced Insurance Law: Coverage Disputes and serves as a Guest Lecturer for, and has taught, the Law School’s introductory insurance law course Insurance Law Principles and Policy.
