Pa. Justices Skeptical That Surety Is Insurance

Patrick Kingsley, partner and chair of the construction and alternative dispute resolution practices at Stradley Ronon, argued before the Pennsylvania Supreme Court on behalf of one of the firm’s surety clients. The matter pertains to a subcontractor’s claim that a surety should be liable under the Pennsylvania bad faith insurance statute because suretyship and insurance are the same thing. 

As reported in Law360, Patrick argued before Pennsylvania’s highest court, asking them to uphold the Superior Court’s ruling that the insurance statute did not apply to sureties. Patrick noted the many well recognized distinctions between suretyship and insurance. Patrick also noted that at the time of the insurance statute’s passage, those distinctions were already well recognized in the law.
