Samuel J. Arena, Jr. served as a moderator and panelist at the Surety & Fidelity Association of America’s Annual Meeting, which was held virtually on Sept. 29 and 30. Arena moderated and presented at the session, “Hey, I Thought That Direct Meant Direct.” The session brought together nationally recognized fidelity insurance coverage practitioners who examined the “direct” causation language in Commercial Crime Policies and Financial Institution Bonds. Panelists provided their views on the history and development of the relevant policy and bond language, including where the courts are in the ongoing “direct means direct” vs. “direct means proximate cause” causation trigger of coverage controversy, and how the industry might address “direct” causation issues in light of the current judicial interpretations of the “direct” causation language.
Arena has concentrated his practice on
insurance law and fidelity and surety law for more than 37 years. A leader in Stradley Ronon’s insurance practice group and the chair of the firm’s fidelity and surety practice group, he represents insurance companies in complex insurance coverage and fidelity and surety matters. Arena has extensive experience representing insurance companies in bad-faith and extra-contractual liability claims and litigation. He is a Fellow of the American College of Coverage Counsel and an Adjunct Professor at Villanova University Charles Widger School of Law, where he teaches Advanced Insurance Law: Coverage Disputes.
