PHILADELPHIA – Stradley Ronon Partner Eric M. Hurwitz and Associate Thomas F. Lucchesi presented at the National Business Institute’s, “Pre-judgment Collections Under the TCPA, FDCPA and CFPB” CLE seminar on Feb. 9. Hurwitz and Lucchesi discussed key rules of prohibitions under the TCPA and FDCPA, reviewed key compliance sticking points, and provided tools to tackle issues, such as filing proof of claim in bankruptcy and oral vs. written revocations of consent.
Hurwitz focuses his litigation practice on defending financial institutions from claims arising out of nearly every type of consumer and commercial financial product. He has extensive experience defending both single plaintiff and class action lawsuits against banks, mortgage lenders and servicers, student lenders, credit card companies, auto finance companies, debt collection companies and other financial services institutions. These include claims under the Truth in Lending Act (TILA), Real Estate Settlement Procedures Act (RESPA), Fair Credit Reporting Act (FCRA), Fair Debt Collection Practices Act (FDCPA) and Telephone Consumer Protection Act (TCPA), as well as state unfair trade practices laws.
Lucchesi focuses his practice on complex state and federal litigation concerning mortgage lending, consumer finance and auto finance, along with a variety of collection matters. Lucchesi brings a strong background representing multibillion-dollar debt collection companies in individual and class action claims concerning the Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), Equal Credit Opportunity Act (ECOA), Telephone Consumer Protection Act (TCPA), as well as unfair and deceptive trade practices statutes.
