Stradley Ronon Partner Gregory DiMeglio discussed the Supreme Court's decision limiting the SEC's statute of limitations on disgorgement's in the Ignites article, "Supreme Court Ruling Could Impact SEC Investigations."
"Shortening the time frame in which the SEC can seek monetary damages may prompt the regulator to shift its investigation and enforcement priorities, says Gregory DiMeglio, chair of securities enforcement at Stradley Ronon. For one thing, it’s possible that investigations into actions or behavior that transpired three or four years ago could get pushed forward in the pipeline more quickly, DiMeglio says. Another possibility is that the agency’s Office of Compliance Inspections and Examinations becomes more selective about which cases it refers to enforcement, he adds. Going forward, the ruling may reduce the likelihood that the SEC brings cases where all of the conduct is more than five years old because there won’t be any monetary component available, says DiMeglio, who previously worked as senior counsel in the agency’s enforcement division."
